Terms of Service

These Terms of Service ("Terms") govern your access to and use of Pickszo applications, our website at pickszo.com, and related services (collectively, the "Service") operated by Pickszo ("Pickszo," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to use the Service and must have legal capacity to enter into these Terms. If you use the Service on behalf of an entity, you represent you are authorized to bind that entity.

2. Nature of the Service

Pickszo is a skill-based sports prediction platform.

  • Outcomes depend on user knowledge and decisions
  • No randomization is used
  • Provided for entertainment purposes only

Availability of features may vary by jurisdiction and platform. You are responsible for ensuring your use complies with applicable laws in your location.

3. No Gambling

Pickszo does NOT offer gambling.

  • No real money winnings
  • No cash prizes
  • No withdrawals

Pickszo does not provide betting or financial advice.

4. Coins (Virtual Currency)

Pickszo uses virtual currency ("Coins").

  • Coins have NO real-world value
  • Cannot be exchanged for money or goods
  • Are non-transferable

Users may:

  • Earn Coins
  • Purchase Coins
  • Lose Coins through gameplay

All purchases are final. Losing Coins is part of gameplay.

Pickszo may modify, rebalance, or discontinue Coin-related mechanics, conversion rates, or rewards at any time in order to protect gameplay integrity, security, and fairness.

5. Purchases

Purchases are processed via Apple App Store or Google Play.

Refunds are governed by those platforms.

Store terms and billing rules may apply in addition to these Terms. In case of conflict for payment processing, the relevant platform's rules control.

6. Competitive Integrity (Fair Play)

You agree NOT to:

  • Create multiple accounts
  • Collude with other users
  • Exploit bugs or systems
  • Use bots or automation

We may suspend or terminate accounts at our discretion.

We may investigate suspicious behavior and take action, including removing results, adjusting balances, limiting features, suspending, or permanently banning accounts.

7. Accounts

You are responsible for your account security and all activity under your account. Keep credentials confidential and notify us immediately of unauthorized access.

We may require verification steps or additional information to protect account integrity and user safety.

8. License to Use the Service

Subject to these Terms, Pickszo grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for lawful, non-commercial purposes.

You may not copy, modify, reverse engineer, distribute, sell, lease, or otherwise exploit the Service except as expressly permitted by law.

9. User Content and Feedback

If you post or submit content (including profile information, messages, or feedback), you represent that you have rights to that content and that it does not violate law or third-party rights.

You grant Pickszo a worldwide, non-exclusive, royalty-free license to host, process, display, and use your content as needed to operate and improve the Service. Feedback you provide may be used by Pickszo without restriction or compensation.

10. Public Data

Some information may be visible to other users:

  • Username
  • Predictions
  • Leaderboard rankings

11. Prohibited Conduct

You agree not to misuse the Service, including by:

  • Violating laws or regulations
  • Attempting to access non-public systems or data
  • Interfering with platform security or performance
  • Harassing, abusing, or threatening other users
  • Impersonating another person or organization
  • Using the Service for unauthorized commercial purposes

12. Changes to Service

We may modify gameplay, scoring, or features at any time.

We may also pause or discontinue parts of the Service, with or without notice, including for maintenance, security, legal compliance, or operational reasons.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access at any time if we believe you violated these Terms, posed risk to users or the Service, or where required by law.

Upon termination, your right to use the Service ends immediately. Sections that by nature should survive will survive termination.

14. Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PICKSZO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR VIRTUAL CURRENCY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) USD $50.

16. Indemnification

You agree to defend, indemnify, and hold harmless Pickszo from claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service, your content, or your violation of these Terms or applicable law.

18. Arbitration and Dispute Resolution

You and Pickszo agree to attempt informal resolution first. If unresolved, disputes will be resolved by binding arbitration in Houston, Texas, except where prohibited by law.

Class or representative actions are not permitted to the extent allowed by law. You may bring eligible claims in small claims court where permitted.

19. Intellectual Property

The Service, including software, design, graphics, logos, and content (excluding user content), is owned by Pickszo or its licensors and protected by applicable intellectual property laws.

20. DMCA / Copyright Complaints

If you believe content on the Service infringes your copyright, send a notice with sufficient detail to investigate at: support@pickszo.com

21. Third-Party Services and App Stores

The Service may depend on third-party services and app stores. We are not responsible for third-party services or policies. Apple and Google may have additional terms that apply to app downloads, billing, and refunds.

22. Changes to These Terms

We may update these Terms from time to time. We will post the revised version with an updated date. Continued use of the Service after changes become effective means you accept the updated Terms.
